No Charges Yet in Deadly Pedestrian Accident on Rockville Pike

ROCKVILLE, Md. - There are still no charges Monday in a deadly accident on Rockville Pike. Two men were killed walking across the street early Sunday morning after being hit by a car. Police suspect the driver had been drinking but he remains free. In a deadly accident like this, police say it's not unusual to wait and sometimes it is weeks before charges are filed. Witnesses heard brakes screeching and the horrific sound as the black Acura hit two men crossing Rockville Pike at Old Georgetown Road just after 3 a.m. Sunday. Officers did process the driver for DUI, which is standard procedure when someone is killed. Police gave the driver a breathalyzer test and took him into custody but he was later released. "We're confident in saying alcohol played a factor in the driver's circumstances, said Captain Paul Starks, spokesperson for Montgomery County Police. We're still looking at the rest of the circumstances in this collision." Two 26-year-olds, Adam Hosinski and Rory Weichbrod died. A relative of one victim said they had gone to a birthday party earlier that night. Investigators are awaiting toxicology reports on the victims. Police say the car's driver stopped, then got back in, drove around the corner, stopped again and returned to the scene. At that time of night, police say the crosswalk signals are off. "What we do know now is that the lights were flashing and the pedestrian indicators were turned off, said Starks. We're still looking at where they were in relation to the crosswalk. When lights are flashing yellow at an intersection, drivers don't have to stop, but they must use caution approaching the intersection. Likewise, police say pedestrians need to look at both directions and get across the street as quickly as possible. In a statement, Weichbrod's sister Erin Carillo wrote, "Rory was a fantastic person that will be missed by many ... With memories of Rory's positive outlook on life, we hope to get through this loss." The two men are the 10th and 11th pedestrians killed in Montgomery County this year. It also happened on one of most dangerous stretches of road. "It's a two-way street out there. We both need to be looking for each other. Pedestrians need to obey the law just like drivers do. Drivers need to yield to pedestrians in the crosswalk," said Jeff Dunckel, the county's pedestrian safety coordinator. Of the county's nine previous pedestrian fatalities this year, police say eight of them involved pedestrian error. Normally it's about 50-50 between drivers and pedestrians at fault.
Police say it will be weeks until its investigation is complete. "We do want to make sure that we charge them [a suspect] with the appropriate charge and we have a lot to look at in this investigation," Starks said. A neighbor of the driver described him as a quiet person who kept to himself. She says he was not known as the "drinking type."
Adam Joseph Hosinski and Rory Joseph Weichbrod, friends since high school, shared more than just the last night of their lives. Both men were 26-year-old Silver Spring natives, 2002 graduates of Our Lady of Good Counsel, and held promising futures in their fields before being struck by a car while attempting to cross Rockville Pike early Sunday. The two were hit and killed by a car around 3:20 a.m. while walking across the Pike near Marinelli Road, police said. Police believe the driver may have been drinking, said Capt. Paul Starks, a spokesman for Montgomery County police. Hosinski, who recently moved to White Flint from the 15100 block of Snowden Drive in Silver Spring, died at the scene. Weichbrod of the 100 block of Lexington Drive in Silver Spring was taken to Suburban Hospital in Bethesda, where he died, Starks said. Hosinski's grandmother, Alice Hosinski, said the two had been good friends since high school and were likely walking back to her grandson's apartment. "He was almost home," she said. Weichbrod worked as a sales representative at the Republic National Distrusting Company's Jessup location a nationwide wine and liquor wholesale company where his employers describe him as an "up and coming performer" who recently earned a promotion. This really is a tragic loss for us," said Stacie Pisano, director of human resources. "It's been a tough time for us here." Erin Carrillo said her brother was a sports enthusiast who as a child loved to play football, baseball, and practicing karate. She said he recently returned to the University of Maryland, College Park to continue his education. Weichbrod is a 2008 graduate of the university and earned a bachelor's degree in business education. Adam Hosinski was an investigative specialist with the Federal Bureau of Investigation's Washington, D.C. field office, following in the footsteps of his father, a retired FBI agent, said Adam's aunt, Mary Manning.
"Anybody would have been proud to have him as a son; he was that guy who everybody wanted to be friends with," she said. "He was well loved." There were witnesses to the collision because a Metro train had just arrived in the White Flint station. Some reported hearing tires screech, some reported hearing a loud thump, Starks said. Witnesses told police the driver, Alejandro Roman, 25, of the 1600 block of Gruenther Avenue in Rockville, got out of his 2010 Acura TSX to check on the men, then drove a couple hundred yards to the next corner and turned onto Old Georgetown Road. Then Roman got out of his car and walked to the crash scene. Police are not sure if Roman made the decision to stop on his own or was stopped by witnesses, who reported he had a female passenger in the car. "We do believe alcohol is a factor with the driver," Starks said. Roman took a breathalyzer test at the 2nd District police station in Bethesda, but police are not releasing the results. Police arrived within four minutes of the first 911 call, Starks said. Police are not sure whether the men were in a crosswalk when they were struck. Roman, who could not be reached for comment, has not been charged. The collision is being investigated by the police Collision Reconstruction Unit, which will report its finding within a few weeks to the State's Attorney's Office, Starks said. The State's Attorney will decide what charges if any the driver will face. These deaths were the 10th and 11th pedestrian fatalities in the county this year. The 12th pedestrian to die in the county, a woman, died after she was struck by two vehicles on Interstate 270 in Gaithersburg on Monday. There were 14 pedestrian fatalities in 2009, Starks said. Eight of the first nine fatalities were related to pedestrian error, he said. A viewing for Weichbrod has been scheduled for 6 p.m. Friday at St. Bernadette Catholic Church, 70 University Blvd. in Silver Spring. A Mass is scheduled at 11 a.m. Saturday, also at St. Bernadette. A public Mass for Hosinski has been scheduled 10 a.m. Friday at St. Andrew the Apostle Church, 11600 Kemp Mill Road in Silver Spring. A viewing has also been set for 6 p.m. Thursday at St. Andrew.
